Free Living Will Declaration
Available in Your State's Statutes
Most states' statutes provide you with a free recommended living will declaration which must be executed in accordance with your state's law.
The authority to execute this document comes from your state. Each state has a law or laws (also known as "statutes") which provide the legal authority for you to make certain decisions in advance.
HOWEVER, It is extremely important that you understand the decisions that your state allows you to make--and the decisions it doesn't. Also, even though you are allowed to make certain decisions and you have the state's recommended form, it is imperative that you understand the definitions the state uses for the language set out in the form.
Each state's statute sets forth language to be used, which, is defined in a very particular way. (This is also set out in the state statutes.) If you use this recommended language, it is predetermined to comply with the laws of your state.
